Legal Groups Challenge Ontario's Cash Bail System

The Canadian Civil Liberties Association and the Criminal Lawyers' Association are seeking to overturn new rules implemented in Ontario that require a cash deposit for bail within two days of release. Previously, cash was only forfeited if release conditions were breached. The legal groups contend these new regulations conflict with the federal Criminal Code, which they argue prioritizes a promise to pay over a cash deposit. Lawyers for the organizations stated that this shift will disproportionately affect low-income individuals, making it harder to secure release and potentially leading to increased pre-trial detention.

Conversely, the province's legal representatives argued that the impact of the new rules is being exaggerated. They asserted that the regulations do not prevent pre-trial release orders and that aspects of bail fall under provincial jurisdiction. The case highlights concerns that the new cash deposit requirement could inadvertently lead to unintended consequences in the bail process.
